On July 1, 2017, the long-awaited Prostitutes Protection Act came into effect. Many people have heard or read about it, but few truly understand what it entails. At Safia Escort, we spared no expense or effort in researching this. What exactly falls under the Prostitutes Protection Act? What changes affect you as a client? What changes for the escort ladies, and what changes for us as an escort agency?

Prostitution in Germany

Prostitution, the oldest profession in the world, has been a legal occupation in Germany since 2001. Until that year, it was not considered a crime but rather a violation of public decency. The changes in the law aimed to shift from "protection from prostitution" to "protection in prostitution" so that individuals who choose to work in the escort industry or as prostitutes have more rights and are more publicly recognized.

Additionally, bringing prostitution into legality is intended to reduce pimping and human trafficking. Although it has been legal to work as a sex worker in Germany, there was no real regulatory framework until 2017. As is common in Germany, there must be rules and regulations for everything, including operating a restaurant or a casino.

What falls under the Prostitutes Protection Act?
Definition:

Prostitution (sexual service) includes anyone who performs a sexual act on at least one person for payment or allows a sexual act to be performed on them for payment. This includes erotic massages, dominatrices, tantra massages, or being sexually touched by a client, which are considered sexual services and acts.

Exceptions: pornography, peep shows, pure table dance performances, webcam services, and phone sex.

Prostitutes are individuals who provide these services

Operators of prostitution businesses are those who commercially offer services related to the provision of sexual services or provide spaces for such services. For example:

  • Operating a service (brothel, sauna club),
  • Providing premises for prostitution (caravans, mobile homes),
  • Organizing, offering, or conducting prostitution events (gangbang parties),
  • Operating a prostitution brokerage.
What changes for you as a client when booking an escort?

As a client, not much will change. Although the number of escorts may decrease, the quality will increase. You will also be offered fewer services, such as sex without a condom, oral/anal, and vaginal intercourse can no longer be advertised or practiced, but otherwise, not much will change.

What changes for the escort ladies?

Anyone who prostitutes themselves, works as an escort or masseuse, or offers other sexual services commercially, must register with the relevant authority as a prostitute.

Persons over the age of 21 must renew their registration every two years, while persons under 21 must renew it annually.

  • Health counseling (every twelve months, every six months for those under 21)

  • Name or stage name (alias name)
  • Photo
  • Date and place of birth
  • Nationality
  • Registered workplaces
  • Validity period (twelve or twenty-four months)
  • Place of issue
